SEVERABILITY
The provider of this rental contract shall be severable so that the unenforceability or waiver of the provisions shall not affect the remaining provisions, RESPONSIBILITY OF USE & DISCLAIMER OF WARRANTIES. You are responsible for the use of the rented items. You assume all risks inherent to the operation and use of rented items and agree to assume the entire responsibility for the defense of, and to pay, indemnify and hold Bibixy Event Services harmless from and hereby release Bibixy Event Services from, and all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Bibixy Event Services’ negligence, from the defective condition of the items, or any other cause.
YOU AGREE THAT NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, HAVE BEEN MADE IN CONNECTION WITH THE EQUIPMENT RENTED.
EQUIPMENT FAILURE
You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair, and will immediately (one hour or less) notify Bibixy Event Services of the facts. Bibixy Event Services agrees at our discretion to make the items operable within a reasonable time, provide a like item if available, make a like item available at another time, or adjust rental charges. The provision does not relieve the renter from the obligations of the contract. In all events, Bibixy Event Services shall not be responsible for injury or damage resulting from the failure or defect of rented items.
USE OF EQUIPMENT
Renter agrees & covenants to be satisfied with the instruction and condition of equipment rented and of the proper and safe use of equipment, or that renter is so familiar and conveyed to Bibixy Event Services you were. Renter further agrees that the items will be used only at the address listed on the contract, and only for the purpose for which it was intended and manufactured. Subleasing or improper use is prohibited. The renter agrees they have read all instruction manuals, operating instructions, and warnings related to rented items where applicable.
TIME OF RETURN
The renter’s right of possession terminates upon the expiration of the rental period outlined in the quote. Time is of the essence in this contract. Any extension must be agreed upon in writing.
INFLATABLE RULES
To ensure the safety of you and your guests as well as our equipment, Bibixy Event Services includes these safety rules as part of our Terms and Agreements that you agree to implement the following.
Attendant Information:
A responsible adult must be attending to/supervising the inflatable and users at all times.
Attendants MUST read and understand the safety booklet and operation information.
Attendants MUST be alert and pay attention to users at all times.
Attendant MUST be standing in a position where he/she has a clear view of riders.
Kids using Bibixy Event Services products should never be left alone without an attendant
Safety Rules:
Riders cannot exceed the maximum weight, height, and number of riders specified on the safety plaque/booklet.
No sharp objects are allowed inside the inflatable (shoes, keys, glasses, necklaces, etc.).
No one allowed in the inflatable that has or might have physical problems, or is under the influence of drugs or alcohol.
Riders must be properly dressed and have socks on to avoid skin burns.
Riders must be of the same age and physical size.
No food, gum, drinks, pets, face paints, or sprays inside of inflatable products.
No rough play inside of inflatable products.
Riders are not allowed to play near the entrance or exit.
Riders are not allowed to jump against, climb or play near the sides or wall nettings.
Riders should not be using inflatable products during inclement weather (rain, wind, etc.).
Riders should be sliding properly demonstrated on safety plaques (feet first).
Emergency Procedures:
If the inflatable begins to deflate or collapse, REMAIN CALM and direct everyone outside of the inflatable as soon as possible.
If someone is trapped inside a collapsed inflatable you must REMAIN CALM, and direct someone to re-inflate the product while helping the person out of the product at the same time.
PARK RESERVATIONS
NOTE: The renter must be present at the park at least 1 hour before the delivery time.
Permits:
Renters are required to obtain a permit from parks that require one before reserving an inflatable from Bibixy Event Services. If a permit is required but the renter did not obtain it or falsified information to Bibixy Event Services, park officials may require the inflatable to be removed immediately, in which case there will be no refund. All permits must be emailed to us at info@bibixyevents.com before your event date.
Insurance:
Bibixy Event Services has full liability insurance and delivers to all city parks that allow inflatables. Renters should reserve inflatables approximately at least a week before the event date to allow time for processing the required documents with the park.
Electricity:
A minimum 3000-watt generator is required for all inflatables going to a park unless the park facility provides electricity, and the renter has ensured there will be a dedicated 15 AMP circuit available. If the renter does not have a generator, they can rent one from Bibixy Event Services before the event.
ELECTRICITY RESPONSIBILITY
Electricity Outlets:
The renter must ensure there are electricity outlets within 50 feet of the set-up area capable of providing a dedicated minimum of 15 Amps for each inflatable. Make sure the electric outlet you intend to use is equipped with a Ground Fault Circuit Interrupter (GFCI, most new electric outlets are). Please check all electricity outlets you plan to use for Bibixy Event Services products to ensure there will be an adequate supply of electricity. Insufficient electricity can create major problems during the rental period (i.e. setup delays, constant deflation, circuit outages), therefore, we urge all renters to make preparations and examine electricity outlets to make sure they will provide sufficient electricity.
Extension Cords:
The renter must provide extension cords to drivers if the setup location is further than 50 feet away from the electric outlet you plan to use. Bibixy Event Services does not provide extension cords beyond 50 feet. Any extension cords used must be a 3-prong cord that is UL and CE approved and no less than 14/3 gauge. Bibixy Event Services is not responsible for faulty/shorted circuit breakers, or power outlets, malfunctions, and damages caused by the use of our equipment including generators, electric blowers, extension cords, and powered rental products. If you have any power concerns, contact us before your event date to discuss them.
LATE RETURNS
Renter shall return rented items to Bibixy Event Services during regular business hours, promptly upon, or before the expiration of the rental period. If the renter does not timely return, the rental rate shall continue until the items are returned.
PAYMENT
Renter shall pay all charges payable under this contract in advance, provided however that all foregoing shall not limit the amount payable by the renter hereunder and all additional amounts hereunder shall be paid immediately as such costs are incurred. The renter shall pay all reasonable costs of collections, court, and attorney fees. If rental charges are not paid within (10) days of the due date, Bibixy Event Services at our discretion may re-calculate rental charges daily and charge the credit card number on file. Renter shall pay in addition to any other amounts payable hereunder, a service charge of 2.0% per month on all past due accounts. There will be a $35.00 charge on any returned checks for any reason.
ADDITIONAL CHARGES
In addition to other charges and costs provided herein, the renter shall pay charges in accordance with company rates then in effect for the following services:
Delivery or Pickup
Delivery or Pickup from any location other than ground level
Setup/knockdown of tables and chairs
Packaging materials are not returned
Service calls
Last-minute or rush orders
CARE OF EQUIPMENT
In addition to its other obligations hereunder; the Renter shall: Pay a reasonable cleaning charge for items returned in an unreasonable dirty condition. Protect the rented items from weather damage, breakage, unauthorized or improper use, theft, or loss while in the possession of the renter.
SITE PREPARATION
The renter must make sure the setup area is ready (i.e., lawns mowed, vehicles/obstacles out of the way, animal feces removed, setup location cleared) before the driver is scheduled to arrive. If the setup area is not ready or accessible when the driver arrives, or if rented products cannot be moved directly to the area (extra handling involved) the renter may be charged an additional delivery fee. If the setup area is not prepared, the driver might be forced to leave and/or reschedule your delivery at a later time, in which case an additional delivery fee may be applied.
Additionally, inflatables require 3 to 4 feet of clearance space on all sides for safe and proper operation. There must be an access route to the setup area with a minimum clearance of 3.5 feet for all inflatable rentals.
Bibixy Event Services is not responsible for damages, alterations, or cosmetic changes to surface areas caused by our rented products setup for any amount of time. Inflatables may ruin grass or turf. If there is a concern about the setup area being damaged or altered, please choose a cement setup area as a setup location.
Underground Utilities:
The renter assumes responsibility for any damage to underground utilities, landscaping, and water lines resulting from product setup. Bibixy Event Services does not assume responsibility for utilities damaged by installation. Please be ready to inform the driver of the existence of any underground utilities (i.e., sprinkler systems, phone lines, gas lines, septic systems, etc.), that may interfere with the ability to stake and/or anchor products. It is recommended you call the “call-before-you-dig” phone number 8-1-1 a few days before our arrival to be informed of any underground utilities in your area. Bibixy Event Services will not be liable for damages to private or city/county property if the renter, or person coordinating on behalf of the renter, does not notify the driver where to or not to anchor the rented products.
PERMITS & LICENSES
Renter agrees before any installation of rental equipment, to obtain at renters expense, any and all necessary permits and licenses, and other consents.
RESERVING EQUIPMENT
Equipment will be reserved upon receipt of a signed and completed rental contract and a non-refundable deposit of 25% of the total charges. This can be paid through Visa, Discover, MasterCard, American Express credit cards, PayPal, or cash. Regardless of the payment method, a credit card number must be placed on file to complete an order. If no credit card number is placed on file, the order will remain a quote.
SECURITY DEPOSIT
The renter shall pay security at the time of reservation on certain high-value items where applicable. This fee is 25% of the total rental charge. The security deposit will be returned upon cancellation up until 3 days before the event date and no more than 7 days after the event is closed. If a security deposit is applied, it will be included in the final invoice.
PAYMENT
All orders are to be PAID IN FULL, before the time of delivery/pick-up. Accepted payment methods are Cash, PayPal, Visa, Discover, MasterCard, and American Express. Items will not be delivered/released unless the total is paid in full, and we have received a signed rental contract. NO EXCEPTIONS. If payment is not made before Wednesday of the event week, the remaining balance will be placed on the credit card number on file. A credit card number must be placed on file, regardless of the payment method. Personal checks are not accepted. Delivery personnel will not accept payment.
PRICING
Pricing is subject to change without notice. Prices represented on the price list and online platforms represent a one-day rental period, which includes renter pick-up/delivery the day before the event, keeping the items for the day of the rental, and renter return/pick-up on the day after the event. If you wish to rent items for an extended period, please contact sales for special rates.
CANCELLATION POLICY
Upon confirmation of a rental order, the renter must pay a 25% deposit to reserve the order. If the renter decides to cancel an order before the event, it must be done 3 days before the event date. If a renter cancels an event within 3 days of the event Bibixy Event Services will retain 25% of canceled items. The renter does, however, have the option to move the rental date, as long as all items are still available, within 12 months of the canceled date. If items originally rented are not available on the new date, similar replacement items will be issued.
Bibixy Event Services reserves the right to cancel inflatable rentals if it is raining and/or if high winds (15 mph or greater) are forecasted. Also, any rental that requires delivery can be cancelled if the weather conditions present dangerous driving conditions that make delivery hazardous. If the local forecast is calling for high winds, or any of the above conditions are present on day of your reservation, we will contact you via telephone or email to reschedule your reservation.
Rescheduling is based on availability for the day requested. The inflatable units are not waterproof; therefore, units cannot be used in the rain. If you feel that rain, high winds, or any other weather conditions are a concern, please bring this to our attention before our arrival and the delivery of the equipment at your location. No Refunds will be provided once the equipment is set up.
Exceptions:
In case of rain or severe weather conditions (i.e., hale, high winds over 15 mph, thunderstorms), the renter is allowed to cancel during the reservation date with no cancellation fee. If the renter cancels the order, it will be canceled for the rest of the day and all payments made will be fully refunded.
DELIVERY/PICK-UP
Delivery and pick-up are available to the renter at an additional, reasonable price. Certain orders may qualify for free delivery based on the order size and event location. The conditions for qualifying for free delivery are set at the discretion of Bibixy Event Services and when applicable, will be specified in the quote. We cannot guarantee a specific delivery/pick-up time. To find out when your order is scheduled for delivery/pick-up, please call the week of your event date indicated on your contract. If a specific delivery/pick-up time is needed, additional fees may apply. Your flexibility is greatly appreciated by our staff. Please keep in mind that rental equipment is the renter’s responsibility from the time of delivery until the time of pickup.
Normal Delivery Prices represent the following requirements:
The area is easily accessible to our trucks.
Equipment is to be unloaded within 20 feet of the tailgate of the truck
All delivered equipment is dropped off in stacks as close to your requested area as can be reached with our delivery vehicle/equipment.
Delivery location must be on the first floor
Delivery must take place during normal business hours 9:00 am-5:00 pm Monday-Friday & 9:00am-Noon Saturday.
RENTER PICK-UP/RETURNS
Renters may pick up most items from the Bibixy Event Services Pearland location during normal business hours if they wish to avoid delivery and pick-up charges. Renters must make an appointment before showing up to pick up any order. Items that are not available for renter pick-up include all large inflatables. Please clean out all debris from the truck/trailer before hauling equipment. If the equipment is returned unreasonably dirty, the renter may be charged for cleaning items. Bibixy Event Services is not responsible for any damages occurring to the vehicle during the loading/unloading of items. All items are to be returned on the date listed on the invoice. If late, additional charges apply.
RETURNS – FINAL INSPECTION
Bibixy Event Services reserves the right to modify charges for broken, missing, damaged, or dirty items up to 14 days after items have been received before going through FINAL inspection. Missing or damaged items will be charged to the credit card number at replacement cost. A detailed invoice for these items will be provided to the client.
BEFORE PICK-UP OR RETURN
Rental Items including Tables and Chairs should be stacked in the same manner they were upon delivery. All cooking, beverage, and concession items should be cleaned and placed back in the containers they were delivered in. Linens should be dry and free of excess garbage to prevent mildew and staining. Additional charges will apply if re-stacking items is necessary. The renter will pay the full replacement cost of linens if they have mildew or staining not removed during normal washing, as well as the full replacement cost for any rental items or storage containers missing upon pick-up.
FOOD/BEVERAGE MACHINES
The above-mentioned items all require a cleanup deposit upon rental, the amount depends on the item. All concession machines MUST be cleaned and returned the same way they were delivered/picked up. If not, the cleanup deposit will be retained by Bibixy Event Services.
INFLATABLES & GAMES
Renters are to abide by the rules and guidelines listed specifically for each inflatable unit. Units are not to be used with water unless designed for such use. If using renter pick-up/return, the unit must be rolled in the same manner as pick-up when returned. If not, a $20 re-roll fee will apply. Any missing balls/accessories are subject to replacement fees. All outdoor inflatables are to be staked at all times.
EQUIPMENT RESPONSIBILITY
All items are to be inspected by the renter at the time of drop-off. If there are problems with items, Bibixy Event Services must be notified within 30 minutes of the delivery. The renter is responsible for the equipment from the time of possession to the time of return. The renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, or damaged, the renter will assume all costs of replacement or repair, including all labor costs. The renter shall pay a reasonable cleaning charge for rented items returned in an unreasonably dirty state. Any items not wanted upon delivery are still to be paid for by the renter.
HOLD HARMLESS AGREEMENT
Renter agrees to assume all risk and agrees to hold Bibixy Event Services and any of its staff harmless from and against any claims, losses, liabilities, and damage, and all costs and expenses arising directly and indirectly at of or relating to:
The delivery, loading, unloading, erection, installation, dismantling, and use of rented equipment
Contact with underground utilities, pipes, or any condition on the renter’s property
All necessary surface repairs
Any injury or damage during the use of rented equipment including inflatables and interactives
EMERGENCY LINE
If the renter does not attempt to contact Bibixy Event Services directly after he/she has had a problem with a rental item, no refund, discount, etc. will be given, NO EXCEPTIONS.
PHOTOGRAPHY
The renter understands that Bibixy Event Services may use pictures or videos of events for promotional/marketing purposes.
